Bolsterstone PLC have submitted a request for a judicial review of the Welsh Assembly Government’s advice that Powys Council should require an Environmental impact Assessment in relation to Bolsterstone / Dulas’ planning application P2012/2012/0573 for road access to the proposed Reeves Hill Windfarm via Llanshay Lane.

The WAG’s advice, “that there is a close interdependency between the access road and the windfarm and that, because of this, the projects involved should be considered cumulatively” would give Powys Council a role equal to that of Herefordshire in deciding whether or not the proposed scheme should be given consent – precisely what that the Developer has so assiduously sought to avoid.

The written request for JR will be considered by the court in Leeds along with the WAG’s written defence. If the request is refused, the Developer may then ask for an oral hearing.
